The Loyalty Program is operated by Hudsons Coffee. By participating in our Loyalty Program, you agree to these Terms and Conditions.

DEFINITIONS

In these Terms and Conditions, the following terms have the corresponding meaning:

App means the Hudsons Coffee online ordering application;

First Free Coffee means a single free barista-made beverage redeemable when you register with our Loyalty Program.

Hudsons Coffee means Emirates Leisure Retail (Singapore) Pte Ltd and its affiliates and related entities (as defined by the Corporations Act 2001 Cth);

Loyalty Card means your Hudsons Coffee Rewards Card on which your Loyalty Rewards are stored;

Loyalty Program means to Hudsons Coffee Rewards Program;

Loyalty Rewards means an amount equal to 10% of your purchase (subject to limitations set out in these Terms and Conditions) of barista-made beverages from an outlet operated by Hudsons Coffee or its franchisees, stored as a credit on your Loyalty Card;

Member means a member of the Loyalty Program;

Privacy Policy means our policies about the handling of your personal information, detailed on our website and accessible from our App; and

Rewards Account means your Loyalty Program account on which your personal details and Loyalty Rewards are stored.

 

THE HUDSONS COFFEE LOYALTY PROGRAM

The Loyalty Program is exclusive to Hudsons Coffee stores.

Hudsons Coffee reserves the right to amend or update these Terms and Conditions from time to time, with or without notice. Any changes or modifications will be effective immediately upon posting the revisions to our website, and you give away any right you may have to receive specific notice of such changes or modifications.

By participating in our Loyalty Program you agree to the Terms and Conditions detailed below. If you do not agree to our Terms and Conditions you may not participate in our Loyalty Program.

 

HOW TO BECOME A MEMBER

The Loyalty Program is our way of thanking and rewarding you for your loyalty and love of coffee. Membership to the Loyalty Program is open to all Australian residents.

To join our Loyalty Program and become a Member, you must Register your details then link to the Loyalty Card. Each email address may only be used for a single membership. Hudsons Coffee may grant or refuse membership in its absolute discretion.

If granted membership to the Loyalty Program, Hudsons Coffee will enter your registered details in the Loyalty Program database. Please refer to our Privacy Policy for further details.

 

LOYALTY REWARDS

The benefits of the Loyalty Program start when you register your details, receiving your First Free Coffee on us.

Your earned Loyalty Rewards will be stored on your Loyalty Card. Loyalty Rewards are  redeemable on all Hudsons Coffee products including beverages and food at any participating Hudsons Coffee store, subject to availability and these Terms and Conditions.

The following rules apply to your Loyalty Rewards:

  1. Loyalty Rewards and special offers cannot be redeemed for cash;
  2. Loyalty Rewards are not transferrable;
  3. Loyalty Rewards cannot be redeemed for alcoholic beverages, newspapers, magazines, flowers or retail coffee machines;
  4. Loyalty Rewards can be redeemed to a maximum value of $50.00 per transaction.
  5. Your First Free Coffee is to a maximum value of  $4.50, and is redeemable only on barista-made beverages. Upgrades to your order for the First Free Coffee that exceed $4.50 can be made at an additional cost to the customer, when ordered in store only.
  6. You can only earn Loyalty Rewards when you purchase barista made beverages. You cannot earn Loyalty Rewards when you purchase any other Hudsons Coffee products.
  7. In order to gain Loyalty Rewards on your Loyalty Account, you must present your registered Loyalty Card, or App or, if ordering online, enter your registered details.  
  8. While every effort will be made to ensure that Loyalty Rewards are correctly recorded on your Reward Account, Hudsons Coffee takes no responsibility for technical errors associated with crediting your Loyalty Rewards to your Reward Account.
  9. When a Rewards Card or App is not presented at the purchase point, written email requests to add Loyalty Rewards to registered Reward Accounts will only be granted in extenuating circumstances, and only with proof of valid receipt where the purchase has been made via Eftpos or Credit Card.
  10. If your Rewards Account has not been used for a period of twelve (12) months it will close and all accrued entitlements and information will lapse. Once your Rewards Account is closed it cannot be re-activated and Loyalty Rewards cannot be redeemed.

 

SPECIAL OFFERS

Hudsons Coffee may provide special offers to some or all Members from time to time. These offers may include additional terms and conditions. Some Members may be ineligible to redeem special offers because of age or other legal requirements. Hudsons Coffee has absolute discretion to determine the eligibility criteria for special offers.  All special offers must be redeemed within the specified dates in the relevant additional terms and conditions.

All special offers are subject to availability, which may vary between Hudsons Coffee stores. Hudsons Coffee bears no responsibility for availability of special offers. You agree to release Hudsons Coffee, its franchisees and store operators from any claim and from all liability arising out of your inability to redeem such special offers.

As a Member, you will be rewarded with an annual free birthday coffee to a maximum value of $4.50. This will be loaded onto your Rewards Account and will be redeemable only on barista-made beverages. This offer is available for 30 days from your birthday as entered upon registering for your Loyalty Program Membership. A customer must register 30 days prior to their birthday to be eligible for the free birthday coffee.

 

WHAT IF I LOSE MY LOYALTY CARD

If you lose or no longer possess your Loyalty Card please present to a Hudsons Coffee outlet and provide them with your contact details. Hudsons Coffee will check the Loyalty Program database for your Membership. If you are an existing Member on the Loyalty Program database we will replace your card. If, for any reason, Hudsons Coffee is unable to confirm that you are an existing Member on the database, you will be required to apply for a new membership by registering online in accordance with these Terms and Conditions. Any Loyalty Rewards previously accumulated will not transfer to the new membership.

 

HUDSONS COFFEE RIGHTS

Hudsons Coffee reserves the right, in its absolute discretion, to suspend your membership in the event that large credit loads accumulate on your Loyalty Account pending investigation into the accumulation of that credit. The Loyalty Reward system is regularly monitored and Hudsons Coffee may terminate your membership if it considers you have used your Reward Card or the Loyalty Program fraudulently or otherwise in contravention of these Terms and Conditions or the law generally.

 

MEMBER RESPONSIBILITIES

You are responsible for the proper use of our website and App, including but not limited to, the proper entry of data and the protection of your login, password and payment details. You agree to accept full responsibility for all your activities on our website and App. You are liable for any loss or damage resulting from your misuse of our software or the improper entry of data.

You will not engage in any conduct on our website or App that is fraudulence or illegal.

You will not modify, alter or copy our software in any way, including the transmission of corruptive or disruptive code to our software.

While we take all reasonable steps to protect your data, you acknowledge that we are not liable to you or any third party for loss or damage caused by a data breach. You also acknowledge that we are not liable for any loss or damage caused by a malfunction of the Loyalty Program software.

If you breach any of these Terms and Conditions, or suffer any loss or damage related to this Loyalty Program, you agree to hold us harmless against any losses, damages or expenses you might suffer.

 

MEMBER DETAILS

As part of these Terms and Conditions, Members are required to provide personal details including: First Name, Last Name, Date of Birth, Email Address and Mobile Number linking to a Loyalty Card or via the App.

Members must update any changes to personal details as soon as possible after that change.

Members can view and update contact details by logging onto our website and by clicking on ‘Members Area’ or via our App.  If you lose or cannot remember your login details or password, click Reset Password and follow the steps. THE HUDSONS COFFEE ONLINE ORDERING APP

The Loyalty Program is administered by a third party service provider Spoonity Inc., while our App is administered by a third party provider, Mobi2Go, a division of Third Screen. Hudsons Coffee is committed to ensuring the privacy of all Member’s information. The use of online ordering will automatically sign you up to the Loyalty Program.

The online ordering system must only be used by persons over the age of eighteen (18) years, or under the supervision of an adult or guardian. Hudsons Coffee reserves the right to refuse service, terminate your access to the website or online ordering, remove or edit any content or cancel your order/s in its sole discretion and without prior notice to you.

While Hudsons Coffee makes the online ordering system (website and App) available for use, Hudsons Coffee does not provide the products or services.  The products or services will be provided by the individual store operators and franchisees (as selected by you or determined based on proximity to the pickup address). Hudsons Coffee makes no warranties or representations regarding the goods and services to be provided (including availability and quality). To the extent permitted by law, you release Hudsons Coffee from any claims or actions you may have in respect of the goods and services.

The App and website cannot provide customers with refunds. If a refund is approved by your store, that store may provide you with a refund onto the credit card that was used to place the order. A refund may take up to 5 business days to be processed.

Hudsons Coffee does not guarantee that the website, App, or online ordering system will be free from viruses or other harmful components and you agree to hold harmless Hudsons Coffee from any claim, judgement, loss, expense, liability from any viruses or harm suffered by you as a result of using the website, App, or online ordering and Hudsons Coffee reserves the right to alter the agreed price if an incorrect price was caused by a software fault, error or malicious attack.

In using Hudsons Coffee online ordering system (whether via the website or App) you acknowledge that all orders are treated as an express intention to purchase the nominated goods or services for the agreed online prices, and acknowledge that you contract with the individual store from which you order and not Hudsons Coffee and therefore you have no claim, recourse or action against Hudsons Coffee whatsoever and indemnify Hudsons Coffee from all claims, losses, judgement, liability and damage relating to a failure of the online ordering system and the provision of the goods and services.
